Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of Avidra and the SMS messaging capabilities we provide. By using our service, you agree to this AUP. Violations may result in immediate account suspension or termination.


1. Permitted Uses

Avidra is designed specifically for legitimate businesses to:

  • Send automated SMS replies to missed callers from their registered business phone number
  • Manage inbound leads generated from missed call recovery
  • Conduct one-on-one SMS conversations with existing or prospective customers
  • View analytics and reports related to call and messaging activity

The service must be used for lawful commercial purposes only, consistent with the nature of your business as registered with Avidra.

2. Prohibited Uses

2.1 Spam and Unsolicited Messaging

  • Sending unsolicited commercial messages (spam) to any recipient
  • Sending bulk or mass SMS campaigns unrelated to missed-call follow-up
  • Using purchased, rented, or scraped phone number lists
  • Sending messages to recipients who have opted out or requested to stop receiving messages

2.2 Illegal and Harmful Content

  • Content that is illegal, fraudulent, deceptive, or misleading
  • Content that violates any applicable law or regulation, including CASL, TCPA, or CAN-SPAM
  • Content that promotes illegal drugs, weapons, human trafficking, or child exploitation
  • Phishing, social engineering, or impersonation of any person or entity
  • Content that threatens, harasses, intimidates, or abuses any individual

2.3 Restricted Industries

The following industry types are prohibited from using Avidra due to carrier and regulatory restrictions:

  • Cannabis, marijuana, or illegal controlled substances
  • Payday loans, high-risk financial products, or debt collection
  • Gambling, casinos, or sweepstakes (where not legally licensed)
  • Adult content, escort services, or explicit material
  • Multi-level marketing (MLM) or pyramid schemes
  • Political campaigns or robocall operations
  • Prescription pharmaceuticals or unauthorized health claims
  • Firearms dealers (where restricted by law)

2.4 Technical Abuse

  • Attempting to circumvent usage limits, rate limits, or security controls
  • Reverse engineering, decompiling, or attempting to extract source code
  • Using the service to attack, probe, or test the vulnerability of any system
  • Introducing malicious code, viruses, or malware through the service
  • Interfering with or disrupting the integrity or performance of the service
  • Creating multiple accounts to evade restrictions or bans

2.5 Resale and Unauthorized Access

  • Reselling, sublicensing, or redistributing the Avidra service without our written permission
  • Allowing third parties unauthorized access to your account
  • Using the service to build a competing product

3. Compliance with Laws

You are solely responsible for ensuring your use of Avidra complies with all applicable laws, including:

  • CASL (Canada's Anti-Spam Legislation) requires express or implied consent before sending commercial electronic messages
  • TCPA (Telephone Consumer Protection Act) applies if you message US phone numbers
  • PIPEDA Canada's federal privacy law governs how personal information is collected and used
  • Provincial privacy laws are applicable in Quebec (Law 25), British Columbia (PIPA BC), and Alberta (PIPA AB)

4. Carrier and Provider Compliance

Avidra operates on top of third-party SMS infrastructure. You agree to comply with the acceptable use and messaging policies of the underlying telecommunications providers in addition to this AUP. Violations of those policies may result in your Avidra number being suspended by those providers, which is outside our control.

Key requirements include registering your messaging use case (A2P 10DLC for US-bound traffic), honoring opt-outs (STOP keywords), and not sending messages to recipients on the TCPA Do-Not-Call Registry.

5. Enforcement

We monitor for AUP violations using automated tools and manual review. If we identify a violation, or receive a credible complaint, we may take the following actions at our discretion:

  • Issue a warning and require corrective action
  • Temporarily suspend your SMS capabilities or account
  • Permanently terminate your account without refund
  • Report the activity to relevant authorities where legally required

We will make reasonable efforts to notify you before taking action unless the violation poses an immediate risk to others or the platform.

6. Reporting Violations

If you believe someone is using Avidra in violation of this policy, please report it to us at support@avidra.net. We investigate all credible reports promptly.
